EPA RMP Rule 2024 Amendments - Overview

The Environmental Protection Agency (EPA) has amended its Risk Management Program (RMP) rule. A final rule was issued on March 11, 2024. It becomes effective on May 10, 2024 and compliance is required generally within 3 years, with some exceptions.

The revisions to the RMP rule include:

  • Changes to the accident prevention program requirements including requirements for addressing:

    • Hazard evaluation of natural hazards

    • Power loss

    • Stationary source siting

    • Safer Technologies and alternative analysis (STAA)

    • Root cause analysis (RCA) incident investigation

    • Third party compliance auditing, and

    • Employee participation

  • Enhancements to the emergency response requirements, and

  • Improvements to the public availability of chemical hazard information

EPA intends to publish guidance for certain provisions, such as STAA, RCA, third-party audits, and employee participation.

The amendments are intended to improve chemical process safety; assist in planning, preparedness, and response to RMP-reportable accidents; and improve public awareness of chemical hazards at RMP-regulated facilities.

EPA believes facility owners are provided with latitude in their methods of implementing the requirements because of the performance-based nature of the RMP rule and the similar nature of the amendments.
